Consumer Health Data Privacy Policy
Effective Date: June 20, 2026
1. Purpose
This Consumer Health Data Privacy Policy describes how Tech Girl LLC ("we") collects, uses, shares, and protects Consumer Health Data, and the rights you have regarding that data. It supplements our main Privacy Policy.
2. What Is "Consumer Health Data"
Consumer Health Data is personal information that identifies your past, present, or future physical or mental health status. For our Platform, this includes: body measurements, weight, body-fat percentage, fitness level and activity, exercise/workout data, injuries and conditions you disclose, and health or fitness goals.
3. Categories We Collect and the Sources
- Categories: the fitness/health categories listed in Section 2.
- Sources: directly from you at sign-up and during use, including any health information you type into messages or chat with your Trainer. We do not currently receive health data from third-party services or wearables.
4. How We Use Consumer Health Data
To provide the Platform's core fitness-coaching functionality: enabling your chosen Trainer to build personalized programs and provide message-based guidance, and to track your progress. We do not use Consumer Health Data for advertising and do not sell it.
5. With Whom We Share It, and Why
- Your chosen Trainer(s) — so they can provide you coaching. We share only with the specific Trainer(s) you select.
- Service providers under contract (hosting, secure storage) who process it on our behalf and may not use it for their own purposes.
- We do not share Consumer Health Data with third parties for their independent use, and we do not sell it.
A list of the specific third parties / affiliates with which we share Consumer Health Data is available on request at privacy@gymatlas.fitness.
6. How We Obtain Consent
- Collection consent: We collect Consumer Health Data only after you affirmatively opt in.
- Separate sharing authorization: Before sharing your Consumer Health Data with your Trainer or any third party (beyond service providers strictly necessary to operate the Platform), we obtain your separate, specific, written authorization, distinct from your collection consent.
- We will not condition core service on consent beyond what is necessary, and you may withdraw consent at any time.
7. Your Rights
You have the right to:
- Confirm whether we are collecting, sharing, or selling your Consumer Health Data;
- Access your Consumer Health Data;
- Withdraw consent to its collection and sharing;
- Request deletion of your Consumer Health Data; and
- Not be discriminated against for exercising these rights.
To exercise these rights, contact privacy@gymatlas.fitness or use the in-app Settings → Privacy controls. We will verify your request and respond within the timeframe required by law (generally 45 days, extendable once). If we deny a request, you may appeal at privacy@gymatlas.fitness.
8. Data Security and Retention
We restrict access to Consumer Health Data to employees, contractors, and Trainers who need it to provide the service, and we use administrative, technical, and physical safeguards including encryption in transit. We retain it only as long as needed to provide the service or as legally required, and delete or de-identify it after a valid deletion request.
9. Changes
We will post changes here and update the Effective Date.
